LEGISLATIVE ACTION

The Legislature concurs with the Executive recommendation.

Article VII

The Legislature concurs with the Executive recommendation to expand the 
Excelsior Linked Deposit Program from $200,000,000 to $300,000,000.  The 
proposal increases the amount of State funds the State Comptroller is 
authorized to invest in linked deposits to $250,000,000.  In addition, the 
Legislature provides the authorization for an additional $50,000,000 from 
Public Authorities funds to be invested in the Excelsior Linked Deposit 
Program, bringing the overall level of funds authorized for investment in 
linked deposits under this Program to $350,000,000.

The Legislature concurs with the Executive's proposal to permit four new 
Empire Zones that were authorized in October 2001 including, Franklin 
County, the City of Mount Vernon in Westchester County, the Village of 
Laurens in Otsego County and Schuyler County to be designated immediately.

The Legislature also authorizes the establishment of six new Empire Zones, 
including four new traditional zones of up to two square miles and two new 
smaller zones of up to one square mile.  These new Zones will be designated 
pursuant to the existing process. 

The Legislature provides for programmatic reforms to the Empire Zone Program 
in order to focus future development in distressed areas.

All newly designated Empire Zones (excluding the four that were authorized 
in October 2001) will be required to include   seventy five percent of the 
zone acreage (900 acres) within three discrete areas of contiguous lands.  
This approach ensures that there are core areas within the zone that are 
designated or targeted for future development.

Up to twenty five percent of zone acreage (320 acres) may be located in 
areas that are not contiguous to the core zone areas if, after a public 
hearing, the following criteria are met:
   --   the creation or retention of permanent, full-time jobs;
   --   a significant investment of capital or human resources on the 
part of the zone business; and
   --   the accessibility of lands to public transportation, where feasible.

If the Empire Zone allocates all 320 acres of its non-contiguous lands, 
an exception is allowed if the lands targeted will create 300 or more new 
jobs.

The future use of any undesignated lands within existing Empire Zones is 
subject to the same 75 percent/25 percent contiguous/non-contiguous ratio 
with the same criteria for the use of non-contiguous lands.
