The Legislature provides $1,125,684,000 for the operating budget for Senior Colleges at the City University of New York (CUNY) and $124,954,000 in operating support for CUNY Community Colleges. This represents an increase of $29,205,000 above the Executive Proposal for the 2003-04 Academic Year. This funding level is intended to avert the need for any layoffs or program reductions. |

The Legislature denies the Executive Proposal to reduce funding for the Search for Education, Elevation and Knowledge (SEEK) Program by 50 percent and provides an additional $7,303,000 to support the full restoration of funding to the 2002-03 Academic Year levels. |

The Legislature denies the Executive Proposal to reduce CUNY Community College Base Aid funding by $345 per full-time equivalent (FTE) student and provides additional Academic Year funding of $19,895,000 to support the full restoration of Base Aid to $2,300 per fte. In addition, the Legislature provides an additional $1,000,000 to fully restore CUNY Community College Contract Courses and an additional $382,000 reflecting a denial of the Executive Proposal to reduce funding for the College Discovery Program by 50 percent. Finally, the Legislature provides an additional $625,000, reflecting a denial of the Executive Proposal to eliminate funding for CUNY Community College Rental Aid. |

The Legislature concurs with the Executive Proposal to provide $55,000,000 to CUNY Community Colleges for a new multi-year capital program. |

Legislative Reductions |
|
The Legislature defers without prejudice the Executive proposal for new capital projects appropriations of $1,001,500,000 for a new multi-year capital program for CUNY Senior Colleges. However, capital reappropriations are provided necessary to support spending for the current Capital plan. |

Legislative Changes |
|
The Legislature provides an additional $32.4 million in revenues from non-resident students to support limiting the CUNY resident student tuition increase to a level of up to $950. Subject to appropriated amounts, additional tuition revenues generated from resident tuition charges may be used at the discretion of the University to offset disbursements from the non-resident offset appropriations. No reduction in the City University of New York appropriation as a result of the exercise of such discretion is intended. |

Article VII |
|
The Legislature provides Article VII language that specifies that $89,090,000 of monies appropriated for the CUNY Senior College Revenue Offset shall be utilized to limit any increase in tuition for resident students. In addition, the Legislature provides Article VII language that specifies that monies appropriated for additional senior college non-resident revenues shall be utilized to limit any increase in tuition for non-resident students. |

The Legislature denies the Executive proposal authorizing the CUNY Board of Trustees to adopt tuition rates prior to the enactment of the State Budget. |
