TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
eliminating earning limitations for retired persons in positions of
public service
 
PURPOSE OR GENERAL IDEA OF BILL:
To remove limitations on retired persons in positions of public service.
 
SUMMARY OF PROVISIONS:
Section 1. Section 212 of the retirement, and social. security law is
amended by adding a new subdivision 2-a to read as follows: 2-a.
Notwithstanding the provisions of subdivision two of this section, there
shall be no earning limitation for retired persons in positions of
public service from the year two thousand twenty-three and thereafter.
§ 2.. This act shall take effect immediately.
 
JUSTIFICATION:
Current limitations on the salary of retired persons prevent employment
in positions of public service. These limitations have contributed to a
teacher shortage throughout the state. Removing these limitations will
allow retired persons be employed part time and fill positions that
urgently need to be filled.

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 212 of the retirement and social security law is
2 amended by adding a new subdivision 2-a to read as follows:
3 2-a. Notwithstanding the provisions of subdivision two of this
4 section, there shall be no earning limitation for retired persons in
5 positions of public service from the year two thousand twenty-five and
6 thereafter.
7 § 2. This act shall take effect immediately.
