NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A9479

SPONSOR: Bronson
TITLE OF BILL: An act to amend the public authorities law, in relation to the mechan- ical insulation energy savings program   PURPOSE: This chapter amendment provides technical changes to the Mechanical Insulation Energy Savings Program to promote program effectiveness and fairness.   SUMMARY OF PROVISIONS: Section one would revise the definition of "applicant" to grant NYSERDA additional discretion; clarify that NYSERDA is required to issue compet- itive grants for the mechanical insulation program; remove NYSERDA's obligation to provide qualified audits; and, require that the mechanical insulation program cover between 50 and 75 percent of qualified mechan- ical insulation expenditures. Section two sets the effective date.   JUSTIFICATION: Chapter 363 of the Laws of 2025, directed NYSERDA to create a Mechanical Insulation Energy Savings Program to lower energy use and carbon foot- prints of large public buildings while saving money and creating new job opportunities for businesses and workers. This chapter amendment makes clarifying changes to ensure NYSERDA can effectively implement and administer the Mechanical Insulation Energy Savings Program.   LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENT: To be determined.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2025 amending the public authorities law relating to establishing the mechanical insulation energy savings program, as proposed in legislative bills numbers S.2457-B and A.3999-B, takes effect.
