Know Your Rights: Stay Safe and Informed

Everyone, regardless of immigration status, has rights under the U.S. Constitution and New York State law. Below are some tips on how to safely navigate interactions with law enforcement to help protect yourself and your family.

  1. Right to remain silent
    You have the right to remain silent about your immigration status when confronted by authorities. You do not have to answer any questions about where you were born, where you live, or your date of birth.

  2. Right to refuse a search
    Law enforcement needs a justified reason to search your home or vehicle. They cannot conduct a search unless they have reason to believe there is criminal evidence inside.

  3. Right to speak to a lawyer before signing anything
    You have the right to fully understand the documents presented. Speak to a lawyer before being pressured into giving out your signature.

  4. Right to record public interactions
    You or someone else in the community may lawfully record video or audio of interactions with law enforcement in public spaces.

  5. Right to ask for an interpreter
    You have the right to request an interpreter. If you do not fully understand what officials are saying or the documents you are given, ask for a translator.
